Terms – Leaping

1. About these terms

These Terms of Sale apply to every order placed on leapingsprouts.com. The store is operated by Leaping Goose Inc., an Ontario corporation (“Leaping Goose,” “we,” “us”). Leaping Sprouts is a brand of Leaping Goose Inc.

By placing an order, you agree to these terms, our Returns Policy and our [Privacy Policy]. You’ll be asked to confirm this at checkout, before you pay.

Nothing in these terms takes away rights you have under the consumer protection laws where you live. Where those laws give you more protection, they apply.

2. Orders, prices and payment

Currency. All prices are in Canadian dollars (CAD). If your card is in another currency, your bank sets the exchange rate and any conversion fees.
Your total. Before you pay, checkout shows the full price: the product, shipping, and any applicable Canadian sales taxes.
When an order is final. Your order is accepted when we email your order confirmation. Before your order ships, we may cancel it if an item is out of stock, a price was listed in error, or we suspect fraud. If we cancel, we refund you in full.
Price changes. Prices may change, but a change never affects an order we’ve already confirmed. We may limit quantities per customer.
Payment. Payments are processed by our payment provider, WooPayments (powered by Stripe). We never see or store your full card number.
Discount codes. One code per order unless the promotion says otherwise. Codes have no cash value, can’t be applied to past orders, and expire as stated. We may end a promotion early, but a code on a confirmed order is always honoured. On a refund, you get back the amount you actually paid.

3. Shipping

Where we ship. We ship to addresses in Canada and the United States.
Cost and timing. Shipping costs and estimated delivery times are shown at checkout. Orders usually ship within 2 business days, and you’ll get tracking by email. Delivery dates are the carrier’s estimates, not guarantees.
Lost or damaged packages. We’re responsible for your order until it’s delivered to the address you gave us. If it’s lost, or arrives damaged, contact us within [14] days with your order number (and photos of any damage). We’ll send a replacement or refund you.
Wrong address. Please check your shipping address. If a package can’t be delivered because of an address error and it comes back to us, we’ll reship it or refund you, less the shipping cost.
U.S. orders: duties and fees. The kit is designed and made in Canada. U.S. customers may be charged import duties, taxes, or carrier brokerage fees on delivery. These aren’t included in our prices and are your responsibility. If you refuse a package because of these charges, we’ll refund the product price once it’s back with us, less shipping costs both ways.

4. Returns, refunds and warranty

30-day returns. Changed your mind? Return your unused kit, complete and in its original condition, within 30 days of delivery. Email us first for return instructions. You pay return shipping, and original shipping isn’t refunded.
30-day defect coverage. If any part of your kit is defective in materials or workmanship within 90 days of delivery, we’ll replace that part. If we can’t, we’ll refund you. We cover shipping on defect claims.
What isn’t covered. Damage from the dishwasher, hot or boiling water, other heat sources, misuse, or normal wear and tear, including discolouration from regular use.
Refund timing. We process refunds within 5 business days of your return arriving, to your original payment method. Your bank may take a few more days to post it.
Your legal rights. This coverage is in addition to any warranties or conditions the law gives you. We don’t exclude those.

5. Using your kit safely

Seeds and jar not included. Use seeds sold specifically for sprouting, from a reputable supplier. The kit fits standard wide-mouth mason jars.
Sprouts carry a food safety risk. Raw sprouts have been linked to food-borne illness, such as Salmonella and E. coli. Health Canada advises that young children, older adults, pregnant people, and anyone with a weakened immune system avoid eating raw sprouts.
What the kit does and doesn’t do. The kit helps you rinse, drain and track your sprouts. It doesn’t sterilize seeds or guarantee a safe crop. Use clean cold water, keep everything clean, and throw out any batch that smells off or shows mould.
Care. The kit is 3D-printed from PLA plastic. Hand wash it in warm, not hot, soapy water. Do not put it in the dishwasher, and keep it away from boiling or very hot water and other heat sources. Heat can warp the parts.
General information only. Sprouting and nutrition information on our site is for general interest. It isn’t medical or dietary advice.

6. Accounts and reviews

Accounts. You can check out as a guest or create an account. You must be the age of majority where you live to create one. Keep your password private and tell us if you think your account has been compromised. We may close accounts used for fraud or abuse.
Reviews. Reviews must be honest and based on your own experience with the kit. No offensive content, spam, links, or other people’s personal information. If we gave you anything in exchange for your review, like a free kit or a discount, please say so in the review.
How we handle reviews. We never edit a review to change its meaning, and we don’t remove reviews for being negative. We may remove reviews that break the rules above.
Permission to show your review. You keep ownership of what you write. You give us permission to display your review and display name on our site and in our marketing.

7. Liability, law and contact

Limit of liability. To the extent the law allows, our total liability for any claim related to an order is limited to the amount you paid for that order, and we aren’t liable for indirect or consequential losses. This limit does not apply to the conditions and warranties you’re entitled to under Ontario’s Sale of Goods Act and Consumer Protection Act, 2002, or under the consumer protection laws where you live. It also doesn’t limit our liability for personal injury caused by our negligence, or anything else the law doesn’t allow us to limit.
Our content. The text, photos, product designs, and the Leaping Sprouts name and logo belong to Leaping Goose Inc. Please don’t copy them for commercial use without our written permission.
Governing law. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, unless your local consumer protection law gives you the right to bring a claim where you live.
Changes. We may update these terms from time to time. The version posted when you place an order is the one that applies to that order.
Delays beyond our control. We aren’t responsible for delays or failures caused by events outside our reasonable control, such as carrier disruptions, strikes, severe weather, or supply shortages. If your order is significantly delayed, you can cancel it for a full refund.
If part of these terms is invalid. If a court finds any part of these terms unenforceable, that part is limited to the minimum extent needed, and the rest stays in effect.
